COMMON QUESTIONS - TOLL VIOLATIONS

The LeeWay Violations Enforcement system was created to deter drivers from violating Florida toll roads and reduce the amount of uncollected toll revenues.

Florida State Law (Statute 316.1001) requires payment of prescribed tolls for the usage of toll facilities. Failure to comply with this statute may result in the assessment of court costs, and suspension of your vehicle registration and/or driver's license.

 

 

If you received a Toll Due Notice and you are a LeeWay customer
 
If you received a Uniform Traffic Citation and are not a LeeWay customer
 
If you missed a toll and are not a LeeWay customer
 

 

 

If you received a Toll Due Notice and you are LeeWay Customer

Receipt of a Toll Due Notice may mean one or more of the following:

  1. There is inaccurate license plate information on your LeeWay account;
     
  2. The transponder is mounted incorrectly, or not mounted, which results in your transponder functioning intermittently and causing toll violations; or
     
  3. The batteries in the transponder need to be replaced.

    To resolve this matter, you must contact the LeeWay Service Center at (239)533-9297. When you call, please have available your transponder number, the notice you received, and vehicle license plate number to update your account information.

Keeping vehicle information updated will often prevent issuance of a violation, but is not a guarantee. It remains the customer's responsibility to follow the guidelines of proper transponder mounting, maintenance and usage. Since processing an image to collect the appropriate toll (V-Toll) is a labor-intensive process, there may be a fee assessed for excessive V-Toll transactions. Please see your LeeWay Licensing Agreement for details.

 

Uniform Traffic Citations

If you are issued a Uniform Traffic Citation (UTC), you must contact the LeeWay Service Center within 40 days from the date of issuance. When you call,please have available your transponder number, the notice you received, and vehicle license plate number to update your account information.

If you do not reply to the notice within 40 days from the date of issuance, the citation will go to the Lee County Clerk of the Court.

Your options are:

  1. Pay the fine.
  2. Contest the citation with the court.

A. PAY THE FINE

Make the money order payable to Clerk of County Court at the address indicated on the citation by the "Must Comply Date" The Civil Penalty will be $129.00 plus toll due.

If you do not meet the "Must Comply Date" on the citation, your driver's license will be suspended and you will not be able to renew your vehicle registration.

B. CONTEST THE CITATION

You must reply within 40 days after the issue date on the citation and request a court hearing to plead "not guilty." Sign, date and send the original citation to the Clerk of County Court at the address located at the bottom of the citation.

The court will schedule a hearing date and notify you. If the county Judge/Traffic Hearing Officer determines that you have committed the offense, the Judge/Hearing Officer may impose a penalty not to exceed $500.00, and points may be assessed, as applicable. If the Judge/Hearing Officer determines that no infraction has been committed, no cost or penalties shall be imposed.

If you do not appear at the time specified by the court, your driver's license will be suspended and you will not be able to renew your vehicle registration until the issue is resolved satisfactorily.

If you received an E-Pass, SunPass or MDX violation and are a LeeWay customer

While making every effort to avoid issuing notices to LeeWay customers with valid and current account information, some roads that are not owned and operated by Lee County have their own violation enforcement system. If you receive a violation notice from the Orlando Expressway Authority, Florida Turnpike Enterprises, or Miami-Dade Expressway Authority, you must contact the LeeWay Service Center at (239)533-9297 to discuss the violation and in some circumstances to submit a dismissal request on your behalf. Please have the details of your violation available (ie: violation date, time, facility, license plate number, violation number).

Uniform Traffic Citations

If you do not respond to a toll due notice, it will result in a Uniform Traffic Citation (UTC). To request a dismissal of a UTC, your account must have been in good standing at the time of the violation. Please contact the LeeWay Service Center at (239)533-9297 within 40 days from the date of issuance. When you call, please have the following available: notice document, transponder number, and vehicle tag number.

If you received a Uniform Traffic Citation and you are not a LeeWay Customer

If you are not a LeeWay customer and received a Uniform Traffic Citation (UTC) for failing to pay a toll you have three options to settle the infraction.

1.

Pay a fine of $100.00 + toll due within 40 days from the issue date of the citation to the LeeWay Service Center. By paying the $100.00 + toll due fine within 40 days, you will prevent the citation from being filed with the court and no points will be assessed to your driver's license record. Make the money order payable to Lee County Toll Enforcement. Personal checks are not accepted. Do not mail cash. You must also sign and date the citation and include it with your payment. Mail to:

If you were not the driver of the vehicle at the time the toll violation occurred, complete, sign and date the Affidavit of Toll/Parking Offense form that was enclosed with your UTC and return it to the Lee County address shown above. Note that submittal of a false Affidavit will subject you to the penalty of perjury and possible contempt of court.

After 40 days, the citation is sent to the Clerk of Courts and a Civil Penalty of $129.00 plus toll will apply. Make the money order payable to the Clerk of County Court and mail to the Court address indicated on the citation. You must also sign and date the citation and include it with your payment.

If you do not comply by the "Must Comply Date" on the citation, you driver's license will be suspended and you will not be able to renew your vehicle registration.

 

3.

Request a court hearing.

You must contact the Clerk of Courts for a hearing. The LeeWay Service Center does not have schedules or status information regarding court hearings.

If you request a hearing and the County Judge/Traffic Hearing Officer determines that you have committed the offense, the County Judge/Traffic Hearing Officer may impose a penalty not to exceed $500.00 and points may be assessed against your driver's license as applicable. If the County Judge/Traffic Hearing Officer determines that no infraction has been committed, no cost or penalties shall be imposed.

If you choose this option and do not appear at the assigned court date, your driver's license will be suspended and you will not be able to renew your vehicle registration until the issue is resolved with the Court. The Court will schedule your hearing date and notify you.

 

 
 

If you missed a toll and you are not a LeeWay customer

If you are not a LeeWay customer and find yourself in an unattended, dedicated LeeWay lane or in an exact-cash lane without change, please continue through the toll plaza. Do not stop and back up, as it is unsafe.

A Toll Due Notice will be issued to the registered owner of the vehicle that violates within approximately 2 weeks. You will have 30 days from issuance of the Toll Due Notice to pay the toll due plus a $3.00 fee. Failure to pay within 30 days of the date issued will result in a Uniform Traffic Citation to be issued. Send all Toll Due Notice payments payable to:
